يعتبر موضوع العملية الانتخابية في ليبيا من المواضيع الجديرة بالدراسة والاهتمام، وهي محط أنظار الباحثين والأكاديميين في الأوسط السياسية والقانونية، حيث أن هذه العملية تحتاج إلى مسألة جوهرية وهي التنظيم القانوني الذي يرتكز على مجموعة من القوانين المنظمة للانتخابات، ولبيان المسائل الإجرائية والموضوعية للعملية الانتخابية وذلك للوصول إلى الحلول الممكنة لإنجاح هذه العملية حتى يتحقق الانتقال الديمقراطي للدولة والتداول السلمي للسلطة، وذلك لبناء دولة القانون والمؤسسات إلا أن هذه العملية الانتخابية قد واجهت صعوبات وعراقيل حالة دون استكمالها على أكمل وجه، وتمثلت هذه التحديات في تحديات داخلية وأخرى خارجية، ومع كل هذه التحديات والمعوقات فإن إجراء الانتخابات أمر ضروري لا يمكن الاستغناء عنه بأي حال من الأحوال، لكي تقوم دولة القانون والمؤسسات ويتحقق الاستقرار في البلاد.

Abstract:

The subject of the electoral process in Libya is considered one of the topics worthy of study and attention, and it is the focus of attention of researchers and academics in the political and legal fields, as this process requires a fundamental issue, which is the legal organization that is based on a set of laws regulating the elections, and to clarify the procedural and substantive issues of the electoral process in order to achieve To the possible solutions to make this process a success so that the democratic transition of the state and the peaceful transfer of power can be achieved, in order to build a state of law and institutions. However, this electoral process has faced difficulties and obstacles that prevented it from being completed to the fullest extent. These challenges were represented by internal and external challenges, and with all these challenges and obstacles Holding elections is necessary and cannot be dispensed with under any circumstances, in order for the state of law and institutions to be established and stability to be achieved in the country.
